These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Inglo, Inc. (“Inglo,” “we,” “our,” or “us”), a Delaware corporation, governing your access to and use of the Inglo platform and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. Eligibility and Account Terms
The Service is intended solely for individuals who are at least 18 years of age. By using the Service, you represent and warrant that you meet this requirement and that all registration information you submit is accurate and complete. Inglo reserves the right to suspend or terminate any account that violates these Terms or that we determine, in our sole discretion, to be associated with fraudulent, abusive, or unauthorized activity.
2. Use of the Service
Inglo provides a self-guided digital journaling platform that enables users to submit written content and receive automated, AI-generated reflections. You agree to use the Service solely for personal, non-commercial purposes and in accordance with these Terms and all applicable laws and regulations. Inglo makes no representations or warranties regarding the continuity, accuracy, or fitness of the Service for any specific purpose.
3. Acceptable Use
You agree not to misuse the Service or assist others in doing so. Prohibited conduct includes, but is not limited to: attempting to gain unauthorized access to the platform or its systems; interfering with or disrupting the operation of the Service; uploading unlawful, harmful, or abusive content; impersonating others; or violating any applicable law or regulation.
4. System Integrity and Fair Use
You are prohibited from attempting to reverse engineer, probe, test, exploit, or interfere with the Service’s algorithms, data models, usage thresholds, or technical limits. Automated access, scraping, prompt injection, or submission of content designed to manipulate or stress the Service is strictly forbidden. Inglo reserves the right to monitor usage levels and enforce rate limits or restrictions at its sole discretion. Accounts found to be in violation may be suspended or terminated immediately and without refund.
5. Subscription and Billing Terms
Access to certain features of the Service may require an active subscription. Subscriptions are processed through a third-party payment processor and are billed on a recurring basis. All fees are non-refundable. Cancellation of a subscription prevents future billing but does not entitle the user to a prorated refund. Users retain access to the Service through the end of the current billing cycle.
6. Account Suspension and Termination
Inglo may suspend, restrict, or terminate your access to the Service at any time and for any reason, including but not limited to violation of these Terms, abuse of the platform, or suspected fraudulent activity. In the event of termination for cause, you are not entitled to any refund or compensation.
7. Intellectual Property
All content, software, visual interfaces, design elements, and algorithms associated with the Service are the exclusive property of Inglo and are protected by intellectual property laws. All AI-generated content produced through the Service is the sole property of Inglo. Users are granted a limited, non-exclusive, non-transferable license to access and use the Service for lawful personal purposes only.
8. User Content and License Grant
You retain ownership of any original content you submit to the Service. By submitting content, you grant Inglo a worldwide, royalty-free, non-exclusive license to use, store, process, and display such content solely as necessary to operate and provide the Service.
9. No Clinical Services Provided
The Service is intended solely for self-guided reflection and informational purposes. Inglo does not provide medical advice, diagnosis, treatment, or therapeutic services. No content generated by or through the Service shall be construed as psychological or clinical guidance. Users experiencing mental health distress or crisis should consult a licensed professional or contact emergency services.
10. Limitation of Liability
To the maximum extent permitted by law, Inglo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or in connection with your use of the Service. The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. Inglo disclaims any and all warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
11. Indemnification
You agree to indemnify, defend, and hold harmless Inglo and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your infringement of any intellectual property or other right of any third party.
12. Force Majeure
Inglo shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, third-party infrastructure outages, labor disputes, government action, or failures of third-party service providers.
13. No Guarantee of Availability or Results
Inglo does not guarantee that the Service will be uninterrupted, secure, or error-free. Inglo does not guarantee that any content generated by the Service will be accurate, appropriate, or achieve any particular result or outcome.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Austin, Texas, and the parties consent to the personal jurisdiction and venue of such courts.
15. Modifications to Terms
Inglo reserves the right to update or modify these Terms at any time in its sole discretion. Changes will become effective upon posting. Continued use of the Service following such changes constitutes acceptance of the modified Terms.
16. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The failure of Inglo to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
